Divorce in Nebraska can cost as little as $200 for the district court filing fee, effective July 1, 2026, if both spouses agree on everything and prepare their own forms, or as much as $20,000+ per side in a fully contested case. Here are the costs to plan for.

Court filing fee: $200 statewide, effective July 1, 2026

Every Nebraska district court charges the same $200 filing fee for a Complaint for Dissolution of Marriage, effective July 1, 2026. The fee is set by statute, so it is identical in every county. This is paid one time when you file your Complaint.

If you cannot afford the fee, every Nebraska district court accepts a Poverty Affidavit (also called In Forma Pauperis). The judge reviews your financial situation and, if approved, waives the filing fee entirely. The form takes about 15 minutes to fill out.

Service of process: $0 to $50

If your spouse signs a Voluntary Appearance, you pay nothing for service. This is the most common path for uncontested divorces.

If your spouse will not sign, you have two paid options: county sheriff personal service (typically $25–$45 plus mileage) or certified mail with restricted delivery ($10–$15 in postage). DivorceQuik generates the Praecipe and Affidavit of Mailing for either path.

Attorney fees: $250 to $500 per hour

Nebraska family-law attorneys typically charge $250–$500 per hour. Most require a $2,500–$10,000 retainer up front. An uncontested divorce handled by an attorney usually costs $1,500–$4,000 total per side. A contested divorce with custody disputes can easily exceed $20,000 per side.

Hiring a lawyer is the right call if your spouse is uncooperative, if there is significant property to divide (real estate, business interests, retirement accounts over $250,000), or if you cannot agree on custody. For straightforward uncontested cases, the cost-benefit calculation usually favors a DIY approach or a flat-fee document-preparation service.
